         CIVIL MISCELLANEOUS APPEAL No.1244 of 2009

JUDGMENT:

1. On 15.03.2023, when the matter was listed the learned counsel for the appellant on record reported that his client has taken no- objection and he does not hold vakalath for the appellant. In the said circumstances, the name of learned counsel for appellant was deleted and the name of appellant was printed in the cause list.

2. On the last date of hearing i.e., 20.03.2023, when the matter was taken up for hearing, there was no representation from the appellant, and therefore, the matter was directed to be posted to today under the caption 'for dismissal'. In spite of matter being listed today under the caption 'for dismissal', there is no representation from the appellant. This shows that the appellant has not evinced any interest in prosecuting the case. Therefore, this appeal is liable to be dismissed for non-prosecution.

3. Accordingly, this appeal is dismissed for non-prosecution. There shall be no order as to costs. In consequence, all the interlocutory applications pending are closed.
