COMMON JUDGMENT:

      Heard appellant No.2 being the legal representative of sole

appellant. On enquiry, she has stated that in view of the death

of her husband, she intend to take back(withdraw) the Appeal

Suit and also made an endorsement to that effect on the

grounds of appeal. Be it stated that on 16.03.2023, she was

brought on record as legal representative of sole appellant.

Therefore,   in   the   above    circumstances,   considering   the

submissions and the endorsement made on the appeal suit, this

application in I.A.No.4 of 2022 is allowed and the appellant is

permitted to withdraw the Appeal Suit.        Accordingly, Appeal

Suit is disposed of as withdrawn.

       However, in the circumstances of the case, there shall be

no orders as to the costs. As a sequel, miscellaneous

applications, if any pending, shall stands closed.
