APPEAL SUIT No.128 OF 2020
JUDGMENT:
None appears on behalf of the appellants. Perused the proceedings dated 16.03.2023 wherein it is mentioned that despite specific directions, personal notice ordered against respondents was not yet returned and no report is filed. There was a representation stating that Sri.T.Prasad, Advocate is appointed as Government Pleader and requested for short time for engaging the services of another counsel and accordingly the matter was earlier listed to 01.03.2023 and again from there to 16.03.2023 and to this day under the caption 'for dismissal'. Therefore, in the above circumstances, presence or representation on behalf of the appellants is felt essential to proceed further. In the absence of any representation, I find no merit to adjourn the matter. Accordingly, Appeal Suit is dismissed for default for non-prosecution. However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
