            WRIT PETITION (TR) No. 5771 OF 2017

ORDER:

This writ petition (TR) is filed with the following prayer "to declare the inaction of the respondents in not absorbing/regularizing the services of the applicants and continuing in service on consolidated pay of meager salary of Rs.1623/- even after working continuous since nearly 37 years treating her as bonded labour and slaves and denying regular absorption against last grade post without communicating any written orders since several decades while regularizing the services of her far juniors without communicating any written reasons since more than 3 decades as unconstitutional illegal totally arbitrary highly illegal irregular against the principles of natural justice equity and fair play and prays to direct the respondents to regularize the services of the applicants as per the judgment of the Hon'ble Supreme Court of India in the case of District Collector/Chairman and others Vs. M.L.Singh and others reported in 2009(8) SCC 480, and pass such other or further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and also award huge compensatory damages for continuing the applicant since 37 years without redressing her grievances nor communicating any written ::2::

reasons for denial of her regularization while absorbing her juniors services as last grade servants since 37 years."

Learned counsel for the petitioner submits that the main grievance of the petitioner is that the respondent authorities are not regularizing the services of the petitioner, even though the petitioner is entitled for regularization as per G.O.Ms.No.212, dated 22.04.1994 and as per the judgment of the Hon'ble Supreme Court in District Collector/Chairman and others Vs. M.L.Singh and others1 and further pray this Court to direct the respondent authorities to consider the case of the petitioner for regularization of services as per G.O.Ms.No.212, dated 22.04.1994 and as per the judgment of the Hon'ble Supreme Court in District Collector/Chairman and others Vs. M.L.Singh and others and pass appropriate orders within a time bond period.

Learned Government Pleader for Services-I appearing for respondents submits that respondent authorities may be directed to consider the case of the petitioner for regularization of services as per G.O.Ms.No.212, dated 22.04.1994 and as per the judgment of the Hon'ble Supreme Court in District Collector/Chairman and 1 2009(8) SCC 480 ::3::

others Vs. M.L.Singh and others, and pass appropriate orders in accordance with law.

In view of the submission made by the learned counsel on either side, this writ petition(TR) is disposed of directing respondent authorities to consider the case of the petitioner for regularization of services as per G.O.Ms.No.212, dated 22.04.1994 and as per the judgment of the Hon'ble Supreme Court in District Collector/Chairman and others Vs. M.L.Singh and others, if the petitioner is otherwise eligible and pass appropriate orders strictly in accordance with law, as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of copy of this order and communicate the same to the petitioner.

5. Accordingly this Writ Petition(TR) is disposed of. Miscellaneous applications, if any pending, shall stand closed. No order as to costs.
