JUDGMENT:
None appears on behalf of the appellants. Despite specific orders for notice, it appears batta was not paid. Report of personal notice is not filed right from inception i.e., from 22.04.2020 onwards. As such, this Court has directed the Registry to list the matter under the caption 'for dismissal' on 06.03.2023. Be it stated that except on 05.01.2023, at no point of time, there was any representation on behalf of the appellants and on that day, a direction was there for payment of process. Report of personal notice was not filed. In these facts and circumstances, I find no merit to adjourn the matter in the absence of proper representation. Accordingly, this Appeal Suit is dismissed for default for non-prosecution. However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
