                     WRIT PETITION No.15916 of 2006

ORDER:

The learned Standing Counsel appearing for the petitioners-Corporation as well as the learned counsel appearing for the respondent No.1 has stated that the issue arising in the present writ petition is squarely covered by the common judgment passed by a Division Bench of the erstwhile High Court of Andhra Pradesh in W.A.Nos.1812 of 2003 and batch, dated 20.07.2010, wherein it was held as under:

"In the circumstances, we do not find any error with regard to the applicability of Section 25-H of the Act and therefore, we are not going into the same. Having regard to the provisions of the Contract Labour (Regulation and Abolition) Act, 1970, and taking into account the principle laid down in the decision relied on by the learned single Judge in STEEL AUTHORITY OF INDIA LIMITED AND OTHERS V.
NATIONAL UNION WATERFRONT WORKERS AND OTHERS1, we do not find any error in the direction given by the Tribunal, as confirmed by the learned single Judge. We do hold that since these workers are employed through an agency, they are sufficiently covered and protected. They cannot be treated as total aliens and need to be extended with benefits."

1 (2001) 7 SCC 1 AAR, J 2 W.P.No.15916 of 2006 Having regard to the above submission and for reasons alike as were stated in the aforestated common judgment dated 20.07.2010 and in terms thereof, the present Writ Petition is dismissed.

Pending Miscellaneous Petitions shall stand closed in the light of this final order. No order as to costs.
