JUDGMENT:
None appears for the appellants. Even as per the proceedings dated 16.02.2023 also there was no representation. Accordingly, the matter was directed to be listed under the caption 'for dismissal'. This Appeal Suit is filed by the appellant/defendant assailing the judgment and decree dated 03.06.2014 in O.S.No.761 of 2010. As such, presence or representation on behalf of appellant/defendant No.1 is felt essential to proceed further. Since the matter is listed today under the caption 'for dismissal', I find no merit to adjourn the matter in the absence of any representation on behalf of the appellants. Accordingly, the appeal is dismissed for default for non-prosecution. However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
