CRIMINAL REVISION CASE No.2 OF 2020
JUDGMENT:
This revision is filed by the petitioner challenging the Judgment dt.31.12.2019 passed in Crl.A.No.49 of 2015 by the V Additional Sessions Judge at Kothagudem, confirming the Judgment passed by the II Additional Judicial Magistrate of First Class at Kothagudem in C.C.No.304 of 2012 dt.01.04.2015, whereby the petitioner was convicted for the offence punishable under Section 326 of the Indian Penal Code and sentenced to undergo imprisonment for three years and to pay a fine of Rs.10,000/-,
2. Heard. Perused the record.
3. Learned Counsel appearing for the petitioner submits that without going into the facts of the case, the imprisonment of 3 years may be reduced keeping in view the old age of this petitioner and also his ailments.
4. As seen from the record, the petitioner had indulged in pouring acid on PW1. According to Ex.P9-Medical Certificate, PW1 received burn injuries on the face and cheek. However, PW1 was 2 not handicapped either by losing eye site or hearing in any other manner.
5. Since the altercation was with respect to a loan transaction and in the said process, the alleged incident occurred, this Court deems it appropriate to reduce the sentence of imprisonment to two years.
6. Accordingly, the Criminal Revision Case is partly allowed reducing the sentence of imprisonment to two (2) years. Since the conviction is confirmed, the concerned trial Court is directed to cause appearance of the petitioner and send him to prison to serve out the remaining part of the sentence.
Miscellaneous applications pending, if any, shall stand closed.
