The writ petition is field seeking to declare action of
respondent No.2 - the Station House Officer, Jagtial Police Station
in not registering crime against respondent No.3 and his henchman for trespassing and damaging the mango grove along with the trees planted under Haritha Haaram flagship programme of the Telangana Government, as illegal and arbitrary.
2. Learned Assistant Government Pleader for Home having received the written instructions dated 02.03.2023 submitted that on verification of station records by the Station House Officer, Jagtial Police Station, it was found that there is no complaint filed by the petitioner. If the petitioner approached the respondent No.2 by filing appropriate complaint, action will be taken as per law.
3. In view of the same, the writ petition is disposed of directing the petitioner to lodge a complaint in accordance with 2 Section 154 of the Cr.P.C. On receipt of such complaint, the Station House Officer, Jagtial Police Station shall conduct enquiry/ investigation by following directions issued in the judgment of "Lalitha Kumari Vs. Government of Uttar Pradesh and others1" dated 12.11.2023. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in this writ petition shall stand closed.
