JUDGMENT:
When the matter was taken up for hearing on 27.01.2017, as none appeared for the appellant and the respondents, it was directed to be listed under the caption 'For Dismissal'. Even today, though the counsel for the respondents appeared, there is no representation on behalf of the appellant.
The civil miscellaneous appeal is accordingly dismissed for non-prosecution. As a sequel to the dismissal of the appeal, the miscellaneous applications, if any, shall stand dismissed as infructuous. There shall be no order as to costs.
