SECOND APPEAL No.392 of 2017
JUDGMENT:
This appeal is filed by the appellant-plaintiff against the judgment dated 30.01.2017 passed in A.S. No.153 of 2015 by the learned XXV Additional Chief Judge, City Civil Court, Hyderabad, whereby the judgment and decree dated 22.01.2015 passed in O.S. No.1483 of 2012 by the learned XXI Junior Civil Judge, City Civil Court, Hyderabad, was confirmed.
2. On 03.02.2023 as there was no representation by the learned counsel for the appellant, the matter was directed to be posted to 28.02.2023 finally. When the matter was taken up for hearing on 28.02.2023, there was no representation by the learned counsel for the appellant and hence, the same was directed to be posted to 09.03.2023 under the caption 'for dismissal'. Even today also, though the matter is listed for dismissal, there is no representation by the learned counsel for the appellant. It appears that the appellant is not evincing any interest to prosecute the matter.
3. Hence, the second appeal is dismissed for default. No costs. As a sequel, miscellaneous applications, pending if any, shall stand closed.
