SECOND APPEAL No.286 of 2017
JUDGMENT:
This appeal is filed by the appellant-plaintiff against the judgment dated 06.04.2017 passed in A.S. No.1 of 2016 by the learned III Additional District Judge, Gadwal, whereby the judgment and decree dated 09.10.2015 passed in O.S. No.112 of 2011 by the learned Senior Civil Judge, Gadwal, was confirmed.
2. On 03.02.2023 as there was no representation by the learned counsel for the appellant, the matter was directed to be posted to 28.02.2023 for hearing on substantial questions of law. When the matter was taken up for hearing on 28.02.2023, there was no representation by the learned counsel for the appellant and hence, the same was directed to be posted to 09.03.2023 under the caption 'for dismissal'. Even today also, when the matter is taken up for hearing, there is no representation by the learned counsel for the appellant. It appears that the appellant is not evincing any interest to prosecute the matter.
3. Hence, the second appeal is dismissed for default. No costs. As a sequel, miscellaneous applications, pending if any, shall stand closed.
