            CIVIL REVISION PETITION No.698 of 2023

JUDGMENT: (Per Hon'ble Sri Justice Abhinand Kumar Shavili)

      The present Civil Revision Petition is filed aggrieved by the

docket order dated 17.02.2023 in I.A.No.207 of 2023 passed in

O.S.No.75 of 2023 by the Principal Junior Civil Judge, RR District

at Shadnagar, seeking suit for injunction and in the said suit.

Petitioners herein have filed I.A.No.207 of 2023 contending that

respondents are selling away the property, and there is an urgency

for grant of injunction order to restrain the respondents from selling the property, but the Court below without appreciating the said urgency, ordered urgent notice and directed to list the matter on 25.04.2023.

The counsel for the petitioners contented that if no injunction orders are granted, the respondents would sell away the property, thus rendering the suit itself as infructuous. Therefore, prayed this Court to pass appropriate orders in the present civil revision petition by directing the parties to maintain Status quo till the court below adjudicates the I.ANo.207 of 2023 on its file.

This Court, having considered the said submissions is of the considered view, that ends of justice would be met if the parties are ::2::

directed to maintain status quo till the respondents file counter affidavit in I.A.No.207 of 2023 in O.S.No.75 of 2023.

The above direction is granted because, if the respondents sell away the property, there would not be anything to adjudicate in the said suit.

With these observations, the Civil Revision Petition is disposed of. No costs.

As a sequel, miscellaneous applications pending if any, shall stand closed.
