CIVIL MISCELLANEOUS APPEAL No.1703 OF 2004
JUDGMENT:
None appears for the appellant - Employees State Insurance Corporation and there is no representation on its behalf. A perusal of the proceeding sheet discloses that on the last two consecutive occasions i.e. 17.10.2012 and 07.11.2012, none appeared for the appellant and there was no representation on its behalf.
In the circumstances, it appears the appellant is not interested in prosecuting the appeal any further and this Court has no option except dismissing the appeal for default/non-prosecution.
Therefore, the C.M.A. is dismissed for non-prosecution. No order as to costs.
