CRIMINIAL REVISION CASE No.89 of 2020
JUDGMENT:
Since last five occasions, when the matter was called on 27.01.2020, 07.09.2020, 22.09.2020 and 12.11.2020, there was no representation for the revision petitioner. Again it was listed on 03.01.2023 but there was no representation for the revision petitioner in the forenoon or in the afternoon. Therefore, the matter was directed to be listed under the caption 'for dismissal' today.
2. Though the matter is coming up under the caption 'for dismissal', today also there is no representation for the revision petitioner either in the forenoon or in the afternoon.
3. Further, this revision is filed against the interlocutory order passed in M.C.No.11 of 2019. As per the Judgment of the Apex Court as well as this Court, there is a bar under Section 397 (2) of Cr.P.C for filing of the revision petition.
4. Therefore, the criminal revision case is dismissed for default and for non-prosecution.
Pending miscellaneous applications, if any, shall stand closed.
