              SECOND APPEAL No.546 OF 2005

JUDGMENT:-

1.    This Second Appeal is preferred against the Judgment

and Decree dated 17.01.2005 in A.S.No.425 of 2003, on the file

of the Court of IX Additional Chief Judge, City Civil Court (FTC),

Hyderabad, wherein and whereby the Judgment and Decree

dated 01.08.2003 in O.S.No.1948 of 2000, on the file of the

Court of V Additional Junior Civil Judge, City Civil Court,

Hyderabad, was confirmed.

2.    There is no representation from the counsel for the

appellants for the last two hearings. Hearing the arguments of

respondent, the Second Appeal was treated as 'Part-Heard'.

3. Even today, when the matter came for hearing, there is no representation from the counsel for appellants. It appears the counsel for the appellants is not interested in prosecuting the Second Appeal.

4. Therefore, the Second Appeal is dismissed as non- prosecution. There shall be no order as to costs.

5. Miscellaneous petitions, if any pending, shall stand closed.
