JUDGMENT:
None appears on behalf of the appellants. Perused the proceedings dated 09.01.2023. On that day also, there was no representation. Notice of respondent Nos.1 to 3 not returned. As such, the Registry was directed to list the matter under the caption 'for dismissal' as the appellants are not evincing any interest in the matter. Therefore, having regard to the above, presence or representation on behalf of the petitioners is felt essential. In the absence of proper representation, I find no merit to adjourn the matter. Accordingly, this Appeal Suit is dismissed for default for non-prosecution.
However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
