CIVIL MISCELLANEOUS APPEAL No.193 of 2009
JUDGMENT:
1. On the last date of hearing, when the matter was taken up for hearing, there was no representation for the appellant, and therefore, the matter was directed to be posted to today under the caption 'for dismissal'. In spite of matter being listed today under the caption 'for dismissal', there is no representation for the appellant. This shows that the appellant has not evinced any interest in prosecuting the case. Therefore, this appeal is liable to be dismissed for non-prosecution.
2. Accordingly, the civil miscellaneous appeal is dismissed for non- prosecution. There shall be no order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
