JUDGMENT:
None appears on behalf of appellants. Today, this Appeal Suit is listed under the caption 'for dismissal'. As per the proceedings dated 09.01.2023 and 23.11.2020 also there was no representation on behalf of the appellants. As such, notice issued to the respondents was not served and no report of personal notice was filed. Accordingly, the Registry was directed to list the matter under the caption 'for dismissal'. Therefore, presence or representation on behalf of appellants is felt essential. I find no merit to adjourn the matter in the absence of proper representation. Accordingly, this appeal Suit is dismissed for default for non prosecution.
However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
