               WRIT PETITION No.5440 of 2011
ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Assignment.

2. Learned counsel for the petitioner submitted that Plot No.429-C situated in Sy.No.77 of Kondapur Village, Serilingampally Mandal, Ranga Reddy District, forms part of Raghavendra Colony Layout in Serilingampally Circle of Greater Hyderabad Municipal Corporation limits, Hyderabad and covered by judgment of this Court in WP.No.21580 of 2008 dated 28.03.2017, wherein the writ petition filed by the original declarant, Linga Rao and his family members challenging the Section 8(4) order under the Urban Land Ceiling and Regulation Act and consequential proceedings was allowed.

3. The aforesaid submission is not disputed by the learned by the learned Government Pleader for Assignment.

4. Recording the same, the writ petition is allowed. The amount collected from the petitioner towards regularization for processing application under G.O.Ms.No.747 Revenue UC.I Department dated 18.06.2008 shall be refunded to the petitioner forthwith. There shall be direction to the respondents to consider the 2 application of the petitioner for regularization of his plot under LRS scheme and also consider his application for building construction, if and when filed by the petitioner, in accordance with law.

Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
