CRIMINAL APPEAL No.1745 of 2017
JUDGMENT :
Basing on the letter dated 18.01.2023 addressed by the learned counsel for the appellants to the Registrar (Judicial), High Court for the State of Telangana, the matter is posted today under the caption "for withdrawal". The said letter discloses that appellant has filed a Memo on 14.11.2022.
2. On perusal of the record, it is evident that Memo is filed by the learned counsel for the appellants which reveals that appellants are not interested to proceed with the appeal and requested the counsel to file a withdrawal petition. Accordingly, the said memo was filed to that effect.
3. It is pertinent to mention that the appeal is filed against the acquittal of accused for the offence under Section 138 of Negotiable Instruments Act. But, in view of the compromise between the parties, the appellants intend to withdraw the case.
4. Recording the said submissions, the criminal appeal is dismissed as withdrawn.
