HON'BLE SRI JUSTICE P.NAVEEN RAO AND HON'BLE SRI JUSTICE NAGESH BHEEMAPAKA APPEAL SUIT NO.215 OF 2020 JUDGMENT : (Per Hon'ble Sri Justice P.Naveen Rao) A memo was filed on 04.03.2022 stating that during the pendency of appeal the appellants and respondents have mutually settled the issue out of Court by way of compromise and therefore, no further orders are necessary in the appeal. However, a letter is filed on 12.01.2023 stating that the Court may permit the appellants to withdraw the appeal with liberty to file petition to restore the petition in future if it is found that the respondents have breached any of the rights or the settlement of terms between the parties.

2. Having regard to this statement made in the letter dated 12.01.2023, we have listed the matter under the caption 'for being mentioned' to seek clarification from the learned counsel for the appellants.

3. Sri N.Chethan Kumar, learned counsel for the appellants informs the Court that he is not pressing the letter dated 12.01.2023 and the appeal may be closed in terms of memo filed on 04.03.2022. -3-

4. In view of the resolution of the dispute, permission to withdraw the appeal is granted and accordingly, the Appeal Suit is dismissed as withdrawn.

Pending miscellaneous petitions, if any, shall stand closed.
