CIVIL MISCELLANEOUS APPEAL No.1613 of 2008
JUDGMENT:
1. The present civil miscellaneous appeal has been directed against order dated 20.11.2008 in I.A.No.193 of 2008 in O.S.No.55 of 2008 on the file of Senior Civil Judge, Peddapalli, whereunder, the interlocutory application filed seeking interim injunction pending suit, was allowed. Aggrieved by the same, the present appeal is filed by the respondent therein.
2. Learned counsel appearing for the appellant submitted that the suit i.e., O.S.No.55 of 2008, itself is disposed of. In the said circumstances, recording the same, this appeal is liable to be dismissed as infructuous.
3. In the result, the civil miscellaneous appeal is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
