APPEAL SUIT NO.3 OF 2021
JUDGMENT:
Heard learned counsel on behalf of the appellant. Perused the letter dated 20.12.2022, submitted to the Registry and the application filed vide I.A.No.1 of 2022 under Section 151 of CPC to permit the petitioner to withdraw the appeal suit, in view of the settlement before the LokAdalat, Khammam.
2. Having regard to the averments of the supporting affidavit, considering the request made by the appellant/ defendant, this Appeal Suit is disposed of as withdrawn, in view of the settlement before the LokAdalat by setting aside the impugned decree dated 03.09.2020 in O.S.No.126 of 2017 on the file of learned Special Sessions Judge for Trail of cases in SC/ST (POA) Act cum VII Additional District Judge at Khammam. No costs.
3. In the circumstances of the case, there shall be no order as to the costs.
4. Miscellaneous applications, if any pending, shall stands closed.
