        CIVIL MISCELLANEOUS APPEAL No.523 of 2008

JUDGMENT:

1. This Court, on 30.06.2022, has dictated an oral order in the open Court during the morning session. However, before the order was signed, learned counsel for the appellants requested to hear the matter in the afternoon session. On the said request, the dictated order was not given effect and the matter was posted for hearing. The present Appeal was again called on 05.01.2023. But, there was no representation from the appellant.

2. Today i.e., on 06.01.2023, this matter is listed under the caption, "for dismissal". But there is no representation for the appellant despite the matter being listed under the caption, "for dismissal". This shows that there is willful lack of diligence on behalf of the appellant in prosecuting the case.

3. In the said circumstances, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No costs.

Miscellaneous Petitions, pending if any, shall stand closed.
