CIVIL MISCELLANEOUS APPEAL No.1028 of 2006
JUDGMENT:
1. On 03.01.2023, when the matter was taken up for hearing, none appeared for both parties and therefore, the matter was directed to be list on 05.01.2023 under the caption "for dismissal". Even today, when the matter is called, there is no representation for the learned counsel for the appellant, in spite of the matter being listed under the caption "for dismissal".
2. Further, on a perusal of the proceeding sheet, it appears that respondent No.1 died, but no steps have been taken till now.
3. In view of the above, it appears that the learned counsel for the appellant is not ready to argue the case. This shows that the appellant is not evinced any interest in prosecuting the case. The appeal is of the year 2006.
4. In the said circumstances, this Civil Miscellaneous Appeal is dismissed for non prosecution. No costs. Miscellaneous petitions pending, if any, shall stand closed.
