CIVIL MISCELLANEOUS APPEAL No.519 OF 2009
JUDGMENT:
1. On 03.02.2023, when the matter was taken up for hearing, there was no representation for the appellants, and therefore, the matter was directed to be posted on 06.02.2023 under the caption "for dismissal". On 20.02.2023 also, there was no representation for the appellant and this Court gave a direction to the Registry to print the name of the learned standing counsel for the appellant and the matter was directed to be posted on 22.02.2023, under the caption "for dismissal". In spite of the matter being listed today under the caption "for dismissal", learned counsel for the appellants is not ready to argue the case. This shows that the appellants have no interest in prosecuting the case. The appeal is of the year 2009.
2. In the said circumstances, this Civil Miscellaneous Appeal is dismissed for non prosecution. No costs. Miscellaneous petitions pending, if any, shall stand closed.
