              WRIT PETITION No.17943 OF 2021

ORDER : (ORAL)

      Grievance of the petitioner is that respondent No.4 - the

Station House Officer, Chandanagar Police Station, Chandanagar, Cyberabad, Hyderabad, has not acted upon his complaints dated 05.05.2021 and 11.06.2020.

2. Learned Assistant Government Pleader for Home, based on the written instructions dated 07.09.2021 issued by respondent No.4, has submitted that complaint dated 11.06.2020 was lodged by the petitioner with respondent No.4 stating that he is owner of the land in Plot No.51 in Survey No.30-A, situated at Shivaji Nagar, Taranagar Village, Serilingampally, Ranga Reddy District. Respondent Nos.5 and 6 viz., Mr. Padma Varma and Chakali Ramu have harassed and dispossessed the petitioner from the subject plot. Pursuant to the petitioner's complaint, respondent No.4 has made an entry in the General Diary and conducted investigation. During enquiry, it was revealed that there was a civil dispute between the petitioner and respondent Nos.5 and 6 2 regarding the subject plot and as per the judgment of the Hon'ble Supreme Court in civil Appeal Nos.1526-1527 of 2005 dated 24.01.2008, the petitioner is not owner of the subject plot. Hence, complaint of the petitioner was closed as 'civil in nature' and intimated the same to the petitioner.

3. In the aforesaid circumstances, no further orders are required to be passed in this writ petition.

4. Therefore, the writ petition is disposed of, at the admission stage itself, granting liberty to the petitioner to invoke appropriate legal remedy, if aggrieved by the closure of enquiry. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
