CRIMINAL PETITION No.11853 OF 2022
ORDER:
1. This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') by the petitioner- respondent to set aside the order in Crl.M.P.No.304 of 2022 in M.C.No.509 of 2022 passed by the II Additional Family Court, City Civil Court, Hyderabad on 29.10.2022.
2. Heard learned counsel for the petitioner and learned counsel for the respondents. Perused the record.
3. The petitioner is the husband questioning the correctness of the orders passed in Crl.M.P.No.304 of 2022 in M.C.No.509 of 2022, dated 29.10.2022 granting interim maintenance of Rs.5,000/- each to the wife and son.
4. Since the orders have not attained finality and the maintenance granted is interim in nature, I do not find any reason to interfere with the order of granting interim maintenance. However, both the counsel submit that in accordance with judgment of Hon'ble Supreme Court in the case of Rajnesh v. Neha in Criminal Appeal No.730 of 2020 arising out of SLP (Crl.) No.9503 of 2018, dated 20.11.2020, the assets and liabilities statements are already filed. In the said circumstances, the II Additional Family Court, City Civil Court, Hyderabad is directed to dispose of the main case itself within a period of four months from the date of receipt of a copy of this order.
5. With the above direction, the Criminal Petition is disposed off.
Miscellaneous applications pending, if any, shall stand closed.
