      CITY CIVIL COURT APPEAL No.217 OF 2017

JUDGMENT:

Heard learned counsel for the appellants and respondent/landlord. Learned counsel for the appellants on instructions submitted that he may be permitted to withdraw the appeal suit. At this stage, learned counsel for the respondent/landlord requested that the appellants may be directed to execute a fresh Lease Deed. Since the appellant intend to withdraw the Appeal Suit filed against the orders in O.S.No.431 of 2013 dated 02.06.2017 on the file of learned III Additional Chief Judge, City Civil Court, Hyderabad, in my considered opinion, no such direction could be given against the appellants.

2. Accordingly, the appellant is permitted to withdraw the Appeal Suit and to that effect learned counsel for the appellant has made an endorsement on the grounds of the appeal. Therefore, while recording the submissions, considering the endorsement made on the grounds of appeal, this Appeal Suit is dismissed as withdrawn confirming the judgment and decree dated 02.06.2017 in O.S.No.431 of 2013 on the file of learned III Additional Chief Judge, City Civil Court, Hyderabad.

3. However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
