APPEAL SUIT No.57 of 2023
JUDGMENT:
Heard learned counsel for the appellants and respondents. Perused the terms of compromise filed along with I.A.No.1 of 2023. Today both the parties of this Appeal Suit are present. Terms of compromise are read over and explained to them. All the parties have agreed that they are true and correctly recorded.
2. As per the terms of compromise, appellant No.1 is allotted Ac.3.00 in Sy.No.100 and Ac.1.20 Gts in Sy.No.169 as shown in Part No.1 in plan-I and plan-II respectively. Similarly, respondent No.2 - Sudha Rani is allotted Ac.2.20 Gts in Sy.No.100 as shown in Part No.2 in plan-I whereas respondent Nos.3, 4 and 5 namely B.Amarender, B.Suneeth Rao and B.Sirisha together are allotted only an extent of Ac.2.20Gts in Sy.No.100 as shown in part No.3 in plan-I.
3. Finally both the parties have agreed to allot the remaining extent towards North side in Sy.No.100 as shown in part No.4 in plan-I to the respondent No.1 - V.Mangamma.
4. In terms of compromise, the Appeal Suit is allowed and the impugned judgment and decree dated 25.02.2020 in O.S.No.7 of 2010 on the file of learned II Additional District Judge, Karimnagar at Jagtial is accordingly set aside. However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
