ORDER: (per Hon'ble Smt. Justice T. Vinod Kumar)
This Writ Petition is filed for issue of writ of certiorari
against the judgment and decree of the Special Court in LGC
178 of 1997 dated 15.12.2006.
2. Today when the matter is listed under the caption 'for
dismissal', a request for grant of time is made by the learned
Counsel appearing on behalf of the petitioner.
3. The matter is listed under the caption 'for dismissal', as
there was no representation for the petitioner even on the last
date i.e, on 25.01.2023. As the matter is listed under the
caption 'for dismissal', the request of the petitioner could not be
acceded to, and the learned Counsel for the petitioner was
informed that the matter would be passed over and he is
required to proceed with the mater in the after-noon session.
4. On the matter being called in the after-noon session,
there was no representation on behalf of the petitioner. The
non-appearance of the learned Counsel appearing on behalf of

the petitioner on the last date of hearing and also in the after-
noon session indicates that the petitioner is not serious in
pursuing the present Writ Petition.
6. Accordingly, the Writ Petition is dismissed for non-
prosecution. No costs.
As a sequel, the miscellaneous petitions, if any pending,
shall stand closed.

3. As the said request could not be acceded to, since the
matter is listed under the caption 'for dismissal', the learned
Counsel for the petitioner was informed that the matter would
be passed over and is required to proceed with the matter in the
after-noon session.
4. When the matter is called again in the after-noon session,
there is no representation. Even on the last date of hearing on
25.01.2023
, there was no representation on behalf of the petitioner and for the said reason the matter was listed today under the caption 'for dismissal'. 5
5. The non-appearance of the learned Counsel appearing on behalf of the petitioner in the fore-noon session and also in the after-noon session indicates that the petitioner is not seriously pursuing the present Writ Petition.
6. Accordingly, the Writ Petition is dismissed for non- prosecution. No costs.
As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
