COMMON JUDGMENT:
The Appellants and all the respondents except respondent
Nos.9, 11, 12, 13, 16, 18, 19 and 22 are present. Learned counsel for both the parties are present and they are identified by their respective counsel.
2. The parties in the Second Appeal has filed application i.e. I.A.No.1 of 2023 to record the compromise and to allow the appeal by setting aside the judgment and decree dated 20.11.2008 in A.S.No.2 of 2008 on the file of the III Additional District and Sessions Judge (Fast Track Court), Medak and to confirm the judgment and decree dated 28.09.2007 in O.S.No.22 of 2002 on the file of Senior Civil Judge, Medak. They have also filed joint memorandum of compromise. The same is taken on record.
3. It is stated by both parties in the joint memorandum of compromise that during the pendency of the appeal, with the intervention of the elders and well wishers, they have negotiated 2 and settled the dispute and they have no objection to allow the Second Appeal by confirming the judgment and decree in O.S.No.22 of 2002 on the file of Senior Civil Judge, Medak in favour of the appellants.
4. In view of the settlement of the dispute between the parties amicably outside the court in terms of the compromise arrived at between them, I.A.No.1 of 2023 is ordered. Consequently, the second appeal is allowed, in terms of the joint memorandum of compromise, which shall form part of the record. There shall be no order as to costs.
5. So far as the claim against respondent Nos.9, 11, 12, 13, 16, 18, 19 and 22 is concerned, the second appeal is dismissed as not pressed by the appellants. There shall be no order as to costs.
6. Miscellaneous applications, if any pending, shall stand closed.
