JUDGMENT:
None appears on behalf of petitioners. As per the proceedings dated 25.01.2023, there was no representation on behalf of the appellants/petitioners. Accordingly, the Registry was directed to list this Appeal Suit along with I.A.No.1 of 2019 which is filed under Section 5 of Limitation Act to condone the delay of 76 days under the caption "for dismissal" to draw the attention of the learned counsel for the petitioners/appellants. Inspite of listing the matter under the caption "for dismissal", there is no representation on behalf of them.
2. Therefore, having regard to the fact that the Appeal Suit is filed in the year 2019 along with delay condonation application and there is no representation on behalf of the appellants, this Appeal Suit is dismissed for default for non-prosecution.
In the circumstances of the case, there shall be no order as to the costs. Miscellaneous applications, if any pending, shall stands closed.
