I.A. No.2 of 2018 in/and C.C.C.A. No.46 of 2018
JUDGMENT:
C.C.C.A. No.46 of 2018 is filed challenging the judgment dated 13.11.2017 passed in O.S. No.1296 of 2015 by the I-Senior Civil Judge, City Civil Court, Hyderabad.
2. When the matter is taken up for hearing, there is no representation by the learned counsel for the appellant/petitioner.
3. Learned counsel for the respondent submitted that on 14.03.2018 this Court granted stay in favour of the appellant on condition of depositing 50% of the decreetal amount. But, the appellant had not complied with the said order and filed I.A. No.2 of 2018 seeking extension of further period of four weeks for depositing the amount.
4. In view of the submission of the learned counsel for the respondent, it is considered fit to dismiss I.A. No.2 of 2018 as well as the appeal as the appellant/petitioner had not complied with the order dated 14.03.2018 passed in I.A. No.1 of 2018.
5. Accordingly, I.A. No.2 of 2018 is dismissed. Consequently, C.C.C.A. No.46 of 2018 is also dismissed. No order as to costs.
Miscellaneous Applications, if any pending, shall stand closed.
