Petition under Section 482 of Cr.P.C. praying that in the circumstances
stated in the memorandum of grounds filed herein, the High Court may be
pleased to quash the proceedings in C.C.No.3/2003 arising out of RC
No.19(A)2000-Hyd on the file of the Special Judge for CBI Cases, Hyderabad
including appearance of the petitioner.
The petition coming on for hearing, upon perusing the petition and
memorandum of grounds filed herein, and upon hearing the arguments of Sri.
Challa Dhanamjaya, Advocate for the Petitioner, and Sri. P. Keshava Rao,
S.C. for CBI Cases for the Respondent, the Court made the following
ORDER:
"It is the submission of the learned counsel for C.B.I Sri. P.Kesava Rao, so far as A-5 to A-7, proceedings in C.C.No.3 of 2003 herein quashed by a Single Judge of this Court, the matter is subject matter of appeal before the Supreme Court admitted pending which requires decision, if at all the petitioner/A-9 wants to rely on that judgment to get benefit at par with them and thereby the matter may be posted to decide after disposal of the Apex Court's expression.
The learned counsel for the petitioner stated that no objection but for dispense with the appearance of the accused meantime for no proceedings or trial can be taken place pending the trial.
Accordingly ordered and post the matter after four months by dispensing the presence of the accused until further orders."
