ORDER:

This writ petition is filedseeking Writ of Mandamus declaring the action of respondents in not treating the petitioner of LingadhariKoya Community as belonging to the Schedule Tribe and not issuing the Scheduled Tribe Certificate to the petitioner as illegal, unjust and contrary to judgment passed in W.P.No.22511 of 2007 dated 20.07.2009.

2. Heard Sri Prasad Ravanaboina, learned counsel for the petitioner and learned Assistant Government Pleader for Tribal Welfare appearing for respondent Nos.1 to 6.

3. Learned counsel for the petitioner submits that the petitioner belonging to the LingadhariKoya Community under the category of Schedule Tribe Community and the respondent authorities have issued ST Community certificate in the year 2016. Pursuant to the employment notification No.2 of 2017 issued by Singareni Collieries Company Ltd., for the post of BadliWorker(Underground), Category-I, the petitioner has made an application through online to the 2 respondentsvide Application No.AA 9937285 requesting them to issue community certificate and the same is required to be produced before the Selection authorities i.e, Singareni Collieries Company Ltd., and till date the respondents have not issued certificate.

Learned Assistant Government Pleader appearing for respondents submits that respondent No.6 is the competent authority to issue Community and Date of Birth Certificate and respondent No.6 may be directed to consider the application submitted by the petitioner andpass appropriate orders, by granting reasonable time.

5. In view of the submissions made by respective parties, without going into the merits of the case, the writ petition is disposed of directing respondent No.6 to consider the application submitted by the petitioner through online videNo.AA 9937285 dated 24.03.2023 and pass appropriate orders, in accordance with law, within a period of three (3) weeks from the date of receipt of a copy of this order.

6. Accordingly, the writ petition is disposed of. No costs. 3

As a sequel, miscellaneous petitions, pending if any, shall stand closed.
