THE HON'BLE THE CHIEF JUSTICE UJJAL BHUYAN
AND
THE HON'BLE SRI JUSTICE N. TUKARAMJI
WRIT APPEAL No.451 of 2023
JUDGMENT: (Per the Hon'ble the Chief Justice Ujjal Bhuyan)
Heard Mr. T.Sharath, learned counsel for the
appellants; Mr. Bala Krishna Mandapati, learned counsel for
respondent No.1/writ petitioner; and Mr. T.Srikanth Reddy,
learned Government Pleader for Revenue for respondent Nos.2, 3, 4 and 5.
2. This appeal is directed against the order dated 22.02.2023 passed by the learned Single Judge in Writ Petition No.5117 of 2023 filed by the 1st respondent.
3. In the said writ petition, appellants have been arrayed as respondent Nos.5 to 8.
4. Respondent No.1 has filed the related writ petition assailing the legality and validity of the endorsement dated 30.01.2023 made by State of Telangana in the Revenue 2 HCJ & NTRJ W.A.No.451 of 2023 Department and further seeks a direction for re-entering his name in the revenue record.
5. Learned Single Judge vide the order dated 22.02.2023 has issued notice making the same returnable on 24.04.2023. Learned Single Judge has further directed interim suspension of the impugned endorsement dated 30.01.2023.
6. On going through the order dated 22.02.2023, we find the same to be an interlocutory one, the next date of hearing being on 24.04.2023.
7. We are therefore not inclined to entertain the writ appeal. However, we grant liberty to the appellants i.e., respondent Nos.5 to 8 in W.P.No.5117 of 2023 to press the interlocutory application stated to have been filed by them for vacation/modification of the order dated 22.02.2023.
8. This disposes of the Writ Appeal. However, there shall be no order as to costs.
3 HCJ & NTRJ
W.A.No.451 of 2023
9. As a sequel, miscellaneous applications pending, if any, in this Writ Appeal, shall stand closed.
