CITY CIVIL COURT APPEAL No. 219 of 2011
JUDGMENT:
Heard learned counsel for the appellants. A memo dated 11.04.2023 is submitted along with letter dated 11.04.2023 submitted in the Registry stating that in view of the Settlement Deed dated 07.05.2019 among the brothers, the appellant intend to withdraw the appeal. To that effect an endorsement is also made on the grounds of the appeal. Therefore, while considering the submissions made by the learned counsel for the appellants, memo dated 11.04.2023, letter dated 11.04.2023 submitted in the Registry and the endorsement made on the grounds of the appeal, this City Civil Court Appeal is dismissed as withdrawn. However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
