COMMON JUDGMENT:
None appears for the appellants inspite of listing the
matter under the caption 'for dismissal'. Perused the earlier
proceedings dated 15.02.2023 and 28.03.2023. It is evident
from the above said proceedings that there was no
representation on behalf of the petitioners/appellants and they
have also failed to take notice against respondent No.4 and
batta was also not paid inspite of granting fair opportunity. Therefore, the matter was directed to be listed under the caption 'for dismissal' only to draw the attention of the learned counsel for the appellants. However, there is no representation on behalf of the appellants. Accordingly, I find no merit to adjourn the matter in the absence of proper representation. I.A.No.1 of 2017 and the Appeal Suit are dismissed for default for non- prosecution. However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
