JUDGMENT:
None appears for the appellants inspite of printing the name of appellant as party in person. Considering the submissions made by the learned counsel for the appellant stating that he has given no objection vakalat to the appellant long back, notice was sent to the appellant from this Court and it is returned with the endorsement as 'incomplete address'. Hence, considering the nature of the dispute, as the appeal is pending since 2018 onwards in a suit for recovery of amount, appeal is filed by the defendant who remained absent, notice of the appellant is returned unserved with the endorsement 'incomplete address', in such circumstances, I find no merit to adjourn the matter. Accordingly, Appeal Suit is dismissed for default for non-prosecution. However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
