COMMON JUDGMENT:

      I.A.No.1 of 2023 is filed under Section 151 C.P.C. with a

prayer to permit the petitioner/defendant to withdraw the

A.S.No.139   of   2020.     Heard    learned   counsel   for   the

petitioner/appellant. Perused the record. Having regard to the

averments of the supporting affidavit and also considering the

fact that the defendant has preferred this appeal, he is

permitted to withdraw the same. Accordingly, I.A.No.1 of 2023

is allowed and Appeal Suit No.139 of 2020 is dismissed as

withdrawn.   However, in the circumstances of the case, there

shall be no orders as to the costs. As a sequel, miscellaneous

applications, if any pending, shall stands closed.
