THE HON'BLE THE CHIEF JUSTICE UJJAL BHUYAN
AND
THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY
W.A.No.1865 of 2022
JUDGMENT: (Per the Hon'ble the Chief Justice Ujjal Bhuyan)
Heard Mr. V.Krishna Mohan, learned counsel for the
appellant and Mr. B.Mukherjee, learned counsel representing
learned Assistant Solicitor General of India for respondents No.2
to 4/ Central Board of Film Certification (for short 'the Board').
2. The related writ petition was filed assailing the certification issued by the Central Board of Film Certification for exhibition of a Telugu movie viz., "Dhenikaina Ready".
3. Learned Single Judge by order dated 28.06.2013 allowed the writ petition by directing the Board to delete two scenes from the said movie.
4. On appeal, a Coordinate Bench stayed the operation of the aforesaid order of the learned Single Judge on 28.11.2013, by taking the view that the subject matter of the writ petition involved public ::2::
interest. Therefore, the learned Single Judge ought not to have exercised the jurisdiction and passed the order dated 28.06.2013.
5. Almost nine years have gone-by since passing of the aforesaid interim order by the Coordinate Bench. Therefore, we are of the view that nothing survives in this writ appeal.
6. Accordingly, the Writ Appeal is disposed of in terms of the interim order dated 28.11.2013. No costs.
As a sequel, miscellaneous petitions, pending if any stand disposed of.
