THE HON'BLE THE CHIEF JUSTICE UJJAL BHUYAN
AND
THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY
W.A.NO.586 OF 2007
ORDER/JUDGMENT: (Per the Hon'ble the Chief Justice Ujjal Bhuyan)
Heard Mr. D. Jagan Mohan Reddy, learned counsel for the
appellants; Mr. Srinivas, learned Standing Counsel for the
Telangana Khadi & Village Industries Board, respondent No.1;
Mr. P.V. Ramana Rao, learned Government Pleader for Mines and Industries for respondent No.2 and Mr. Parsa Ananth Nageshwar Rao, learned Government Pleader for Revenue appearing for respondent Nos. 3 & 4.
2. This intra-court appeal is directed against the order dated 22.12.2006 passed by the learned Single Judge disposing of writ petition No. 8297 of 1993.
3. Appellants had filed the related writ petition questioning the proceedings initiated by the respondents for recovery of Rs.11,74,800.00 as arrears of land revenue. While dismissing the writ petition, learned Single Judge held that as per Section 7 of the Andhra Pradesh Revenue Recovery Act, 1864, interest on arrears of ::2::
revenue cannot exceed 6 % p.a., and therefore, interest on arrears due in the present case cannot exceed 6 % p.a.
4. Upon hearing learned counsel for the parties and on going through the materials on record including the reasons given by the learned Single Judge, we find no good ground to interfere with the order dated 22.12.2006 passed by the learned Single Judge in W.P.No.8297 of 1993. Respondents, as substituted, would be entitled to recover the principle amount along with interest @ 6% p.a., after crediting the amount already paid by the appellants as well as realised through auction.
5. Writ Appeal is accordingly disposed of. No costs.
As a sequel, miscellaneous petitions, pending if any, stand closed.
