CRIMINAL APPEAL NO.1858 OF 2009
J U D G M E N T:
The present Criminal Appeal is filed under Section 378 (4) of Code of Criminal Procedure, 1973 (for short "Cr.P.C") by the appellant/complainant aggrieved by the judgment of acquittal recorded by the II Additional Chief Metropolitan Magistrate at Hyderabad on 25.03.2009 in C.C.No.1313 of 2003 finding the Respondent Nos.1 and 2/Accused Nos.1 and 2 not guilty for the offence punishable under Section 138 of Negotiable Instruments Act.
2. Sri.A.H.Ramakrishna Rao, learned counsel for appellant/complainant submits that the issues have been settled between the parties and seeks permission of this Court to withdraw the criminal appeal.
3. In view of the said submission of the learned counsel for the appellant/complainant permission is accorded.
4. Accordingly, the Criminal Appeal is dismissed as withdrawn.
Miscellaneous applications pending, if any, shall stand closed.
