Petition under Section 389(1) of Cr.P.C. praying that in the circumstances stated in the
Memorandum of Grounds filed in Crl.A, the High Court may be pleased to suspend the
sentence of imprisonment made in the Judgment dt. 19-01-2009 in SC.No. 196 of 2004 on
the file of the Court of Special Judge for NDPS Cases-cum-I Addl. Sessions Judge,
Warangal and release the petitioner on bail, pending Crl.A.No.128/2009 on the file of the
High Court.
The Appeal coming on for hearing upon perusing the petition and Grounds filed in Crl.A. and
upon hearing the arguments of Sri A.Prabhakar Rao, Advocate for the Petitioner and of the
Public Prosecutor for the Respondent, the Court made the following
ORDER:
" Pending appeal, the sentence imposed on the petitioner is suspended and it is directed that the petitioner shall be released on bail on his executing a personal bond for Rs. 10,000/- (Rupees ten thousand only) with two sureties of a like sum each to the satisfaction of the learned Special Judge for NDPS Cases-cum-I Additional Sessions Judge, Warangal. In addition to that the petitioner shall also deposit a sum of Rs. 25,000/- (Rupees twenty five thousand only) towards security for his future presence."
