JUDGMENT (per AKS,J):
When the matter is taken up for hearing, it is noticed that both the appellant and the contesting 3rd respondent have retired from service on attaining the age of superannuation and the appellant is seeking seniority over and above the 3rd respondent. Therefore, in view of the fact that both the appellant as well as 3rd respondent have retired from service, this Court is of the considered view that the cause in the Writ Appeal cannot be adjudicated on merits and at this point of time, this Court cannot interfere with the impugned orders of the learned Single Judge.
Accordingly, the Writ Appeal is dismissed. No costs. Miscellaneous petitions pending, if any, shall stand closed.
