        Heard Ms. Anushka Rastogi, learned counsel for the

petitioner; Mr. Ajay Kumar Kulkarni, learned counsel

appearing           for       Income           Tax        Department    and

Mr. B.Mukherjee, learned counsel appearing for Union of

India.


2.      It is submitted that the present writ petition is

covered by the common judgment delivered on 13.09.2022

in W.P.No.33191 of 2022 and batch (M/s. Neopride

Pharmaceuticals                Limited          v.        The   Adjudicating

Authority) which were allowed.


3.      Accordingly, the present writ petition is also allowed

in terms of the aforesaid judgment.

     Miscellaneous applications pending, if any, shall

stand closed. However, there shall be no order as to costs.
