CRIMINAL APPEAL NO.1110 OF 2009
J U D G M E N T:
The present Criminal Appeal is filed under Section 378 (4) of Code of Criminal Procedure, 1973 (for short "Cr.P.C") by the appellant/complainant aggrieved by the judgment of acquittal recorded by the Judicial Magistrate of First Class, Special Mobile Court at Sangareddy on 10.06.2009 in C.C.No.175 of 2009 finding the Respondent No.2/Accused not guilty for the offence punishable under Section 138 of Negotiable Instruments Act.
2. Learned counsel for appellant/complainant submits that the matter has been settled outside the Court between the parties and seeks permission of this Court to withdraw the criminal appeal.
3. In view of the said submission of the learned counsel for the appellant/complainant permission is accorded.
4. Accordingly, the Criminal Appeal is dismissed as withdrawn.
Miscellaneous applications pending, if any, shall stand closed.
