JUDGMENT: (Per the Hon'ble the Chief Justice Ujjal Bhuyan)
Heard Mr. T.Raghavendra Singh, learned counsel for
the appellant and Mr. Ch.Jagannatha Rao, learned counsel
representing Osmania University.
2. This writ appeal is directed against the order dated
28.09.2022 passed by the learned Single Judge dismissing
W.P.No.37680 of 2022 filed by the appellant and two
others.
3. The related writ petition was filed seeking a direction
to the respondents to consider the case of the appellant for
promotion to the 4th year (VII semester) in the 5 years LLB course for the academic year 2022-23.
4. Though the writ petition was filed by three petitioners, it is only petitioner No.1 who has carried his grievance in writ appeal, being the sole appellant. 2
5. Till the VI semester, appellant has total of eight backlogs. As per the relevant rules of the Osmania University, for promotion to the next year, a student cannot have more than five backlogs. In view of the aforesaid legal position, learned Single Judge declined to entertain the writ petition observing that appellant had not questioned such a rule.
6. We see no good ground to interfere with such finding of the learned Single Judge.
7. That being the position, the writ appeal is dismissed.
Miscellaneous applications pending, if any, shall stand closed. However, there shall be no order as to costs.
